Card Catchers LLC: Master Terms of Service Last Updated: April 9, 2026
1. Acceptance of Terms
By accessing or using the Card Catchers LLC website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Master Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Card Catchers LLC (“Company,” “we,” “us,” or “our”).
If you do not agree to these Terms, you must not access or use the Platform. We may update these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review the Terms periodically.
2. Definitions
- Buyer: Any user purchasing items on the Platform.
- Seller: Any user listing or selling items on the Platform.
- User Content: Any listings, descriptions, images, reviews, communications, or other content you upload or submit.
- Services: The C2C marketplace platform provided by the Company to facilitate transactions between Buyers and Sellers.
3. Nature of the Platform & Disclaimers
The Platform is a Customer-to-Customer (C2C) marketplace that provides only the technical infrastructure to enable Buyers and Sellers to connect and transact. We are not a party to any contract formed between Buyers and Sellers. We do not guarantee, endorse, or assume any responsibility for the accuracy, quality, safety, legality, or delivery of any items listed or sold. All transactions are solely between the Buyer and Seller.
The Platform is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Investment Disclaimer: Any pricing data, market trends, or other information on the Platform is for informational purposes only and does not constitute financial, investment, or professional advice. You assume all risks associated with your use of the Platform.
No Affiliation: Card Catchers LLC is an independent entity. Pokémon and all related trademarks are the property of Nintendo, Creatures Inc., GAME FREAK, and/or their respective owners. Use of these marks is solely for identification and does not imply any endorsement or affiliation.
4. Eligibility & User Accounts
You must be at least 18 years old to create an account or use the Platform. We do not knowingly collect data from children under 13 (COPPA compliance). By creating an account, you represent that you are at least 18 and have the legal capacity to enter into binding contracts.
You agree to provide accurate, current, and complete information during registration and to update it promptly. Accounts are non-transferable. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may maintain only one account unless we expressly authorize otherwise. We reserve the right to suspend or terminate accounts at our sole discretion for any violation of these Terms.
5. Seller Obligations & Financial Operations
- Fee Schedule: Sellers agree to a total deduction of 12.9% + $0.30 per transaction (10% Marketplace Commission + 2.9% + $0.30 Shopify Payment Processing). Fees are subject to change with notice.
- Payouts & Escrow: Payments are held in escrow. Payouts are initiated no sooner than 48 hours after confirmed delivery (via tracking showing delivery), provided no dispute is filed. We may impose holds, delays, or offsets for suspected fraud, disputes, chargebacks, or policy violations.
- Tax Compliance: Sellers are solely responsible for collecting, reporting, and remitting all applicable taxes. We will issue Form 1099-K where required by law (currently $20,000 and 200 transactions). High-volume sellers must comply with the INFORM Consumers Act by providing verified contact and tax information.
- Seller Representations: By listing an item, you warrant that (i) you have legal title and physical possession of the item, (ii) the item is authentic and accurately described, (iii) the listing complies with all laws, and (iv) you will not engage in drop-shipping or sell items you do not possess.
6. Authenticity, Prohibited Items & Card Condition Standards
Zero-Tolerance Policy: The sale of counterfeit, proxy, replica, or altered cards is strictly prohibited and will result in immediate, permanent account termination and reporting to authorities where appropriate.
Prohibited Items: Weighted packs, resealed products, “Mystery Boxes,” unauthorized fan-art that infringes third-party IP, stolen goods, or any items that violate applicable laws.
Card Condition Standards: Sellers must grade conservatively using these benchmarks:
- Near Mint (NM): Minimal to no wear; pack-fresh appearance.
- Lightly Played (LP): Minor edge whitening or light surface scratches.
- Moderately Played (MP): Noticeable whitening, minor chips, or surface wear.
- Heavily Played (HP): Major whitening and scratches, but structurally intact.
- Damaged (DMG): Creases, water damage, ink marks, or other defects.
Sellers must provide clear, accurate photos and descriptions. We reserve the right to remove listings that violate these standards.
7. Shipping Policy
Card Catchers LLC is a Customer-to-Customer (C2C) marketplace. We do not ship items ourselves — all shipping is handled directly by the Sellers. This policy outlines the shipping requirements and best practices for both Buyers and Sellers.
Seller Shipping Requirements
- Shipping Timeline: Sellers must ship all orders within 2 business days of payment confirmation and provide tracking information to the Buyer via the Platform.

Packaging Recommendations: We strongly recommend protecting cards with the following best practices:
- Place each card in a penny sleeve.
- Insert into a rigid top loader or between cardboard for protection.
- Seal in a team bag (or clean sandwich bag).
- Ship in a padded bubble mailer or rigid envelope. While we encourage strong protection, we do not mandate a specific “Sandwich” method. Sellers should use reasonable care to prevent damage during transit.

Tracking Requirements:
- Orders under $20: Tracking is optional but highly recommended.
- Orders $20 and above: Tracking with delivery confirmation is strongly recommended.
- Orders $50 and above: Tracking with delivery confirmation is required.
- Orders $250 and above: Signature confirmation is required.
- Shipping Costs: Buyers pay shipping costs at checkout, as set by the Seller. Sellers are responsible for choosing a reliable carrier (USPS, UPS, or FedEx).
Buyer Expectations
- Inspect packages promptly upon delivery.
- Report any issues through the Platform’s dispute system within 7 calendar days of delivery.
- For missing packages, allow reasonable transit time plus 7 business days after the carrier’s estimated delivery date before filing a claim.
International Shipping International shipping is at the Seller’s discretion. Buyers are responsible for all customs duties, taxes, and import fees. Card Catchers LLC is not responsible for international shipping problems.
Lost or Damaged Packages
- If tracking shows “Delivered,” claims for non-receipt are generally not eligible.
- For lost packages with valid tracking, the Seller or Buyer may file a claim with the carrier.
- Card Catchers LLC may assist with mediation between Buyer and Seller but assumes no liability for lost or damaged shipments.
8. Return and Refund Policy
Card Catchers LLC operates as a Customer-to-Customer (C2C) marketplace. All sales are made directly between Buyers and Sellers. We provide the platform and facilitate disputes, but we are not a party to any transaction.
All Sales Are Final Returns and refunds are not accepted for change of mind, buyer’s remorse, or minor subjective differences in card condition or appearance. Please review all photos, descriptions, and condition details carefully before purchasing.
Eligible Reasons for Returns or Refunds A return or refund may only be requested in the following cases:
- Significantly Not As Described (SNAD) The received item materially differs from the listing description or photos. Buyers must submit a dispute within 30 calendar days of the estimated delivery date.
- Damage During Shipping The item arrives damaged due to shipping. Claims must be filed within 48 hours of delivery.
- Counterfeit, Replica, or Altered Items Suspected counterfeit or fake cards must be reported within 30 calendar days of the estimated delivery date. In confirmed cases, a full refund will be issued.
Partial vs. Full Refunds
- For minor condition differences, Sellers may offer a partial refund (typically 10% per condition step, e.g., NM to LP).
- Full refunds are generally limited to major discrepancies, shipping damage, or proven counterfeits.
Return Process
- All returns and refund requests must be filed through the Card Catchers LLC dispute system.
- Buyers and Sellers should attempt to resolve issues directly and in good faith.
- In approved return cases, the Seller will provide a prepaid return shipping label.
- Returned items must be sent back in the same condition as received.
- Refunds are processed to the original payment method (usually within 5–7 business days).
Missing or Lost Packages Buyers must allow reasonable transit time plus 7 business days after the carrier’s estimated delivery date before filing a missing package claim.
International Orders International returns are rarely approved except in cases of proven counterfeits. Buyers are responsible for all return shipping costs, customs fees, and related issues.
Important
- Card Catchers LLC may mediate disputes but does not guarantee any specific outcome and assumes no liability for disputes between Buyers and Sellers.
- Repeated failure by Sellers to honor valid refund requests may result in account restrictions or termination.
- This Return and Refund Policy is part of our Master Terms of Service.

9. Community Conduct & Prohibited Activities
You agree not to: harass other users, “shark” deals, move transactions off-platform to avoid fees, engage in fraudulent activity, create multiple accounts to manipulate the market, or post offensive, defamatory, or infringing content. Violations may result in immediate suspension or permanent termination.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Platform; (ii) your listings, sales, or purchases; (iii) your breach of these Terms; or (iv) your violation of any law or third-party rights. This provision survives termination of your account.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC TRANSACTION IN DISPUTE. We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, even if advised of the possibility. This limitation applies regardless of the legal theory.
12. Dispute Resolution
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Illinois before a single arbitrator under the rules of the American Arbitration Association (or another mutually agreed provider). You waive any right to a jury trial or class-action participation. Arbitration is confidential and the arbitrator’s decision is final and enforceable in court. This provision survives termination.
13. Privacy & Data Handling
We collect data as necessary for payment processing, the INFORM Act, and Platform operation. Data is stored with reasonable security procedures. We do not sell user data to third parties. Our Privacy Policy (separate document) provides additional details and is incorporated by reference.
14. Termination
We may terminate or suspend your account at any time, with or without notice, for any reason, including violations of these Terms. You may terminate your account at any time, but ongoing obligations (e.g., fees, indemnification) survive.
15. Miscellaneous
- Governing Law: These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles.
- Illinois Corporate Veil: The Company operates as a separate legal entity. Users acknowledge that all transactions are with the LLC and that the corporate veil is maintained through strict separation of personal and business assets.
- Severability: If any provision is held invalid, the remainder remains in full force.
- No Waiver: Our failure to enforce any right does not constitute a waiver.
- Entire Agreement: These Terms constitute the entire agreement between you and the Company.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, pandemics, strikes).
By using the Platform, you acknowledge that you have read, understood, and agree to these Terms.
